"SHEIN," "the Company," "we," "us," and "our" as used in these Terms and Conditions refer to Fashion Choice Pte. Ltd. and its affiliates. "You" or "your" refers to the individual or entity that submits images, designs, text, or other content ("Content") on www.shein.com for inclusion in customized products, or that purchases such products. If you wish to purchase customized products on www.shein.com, you must accept these Terms and Conditions without modification.
By clicking the "Customize Now" button or ordering a customized product, you agree to be bound by these Terms and Conditions, including but not limited to[SHEIN Privacy Policy]and the[SHEIN Terms and Conditions]as amended from time to time. 1.Content: You may submit your own Content or select from the design and image library to create customized products. You may only submit Content that complies with SHEIN's Terms and Conditions, which prohibit pornographic, defamatory, libelous, infringing, obscene, or racially, ethnically, or otherwise objectionable content, as well as content that violates applicable laws (including intellectual property laws). We expressly reserve the right to reject any non-compliant material.
2. License to Your Content: You hereby grant SHEIN, its affiliates, and sublicensees (including third parties providing customized products and related services) (collectively, the "Customization Providers") a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right, in connection with the production and purchase of customized products, to use, reproduce, modify, adapt, publish, perform, translate, create derivative works of, distribute, and display the Content you submit (including the name and likeness of any individual appearing in the Content).
Please note that we will use your Content solely to provide services to you and fulfill your customized product order. We will not use, sell, or distribute your uploaded content or any personal information for any other unauthorized purpose.
3. Representations, Warranties, and Indemnification: You represent and warrant that you have the right to grant the licenses set forth in these Terms and Conditions; that the Customization Providers' use of the Content will not violate, misappropriate, or infringe any intellectual property rights or otherwise cause harm to any individual or entity; and that you will defend, indemnify, and hold harmless the Customization Providers from any losses, damages, judgments, settlements, costs, interest, and any other liabilities (including reasonable attorneys' fees and costs) related to or arising from any third party.
4.No Resale: Reselling, offering for sale, or otherwise making available to any person, in whole or in part, customized products, at any location, directly or indirectly, through online or offline channels, is prohibited. The customization service is intended solely for personal purchase of products, and you agree not to use the service for the business operations of a product provider or for any commercial enterprise or purpose, unless specifically authorized in writing by SHEIN. To avoid potential risks, you may not order more than 10 customized products at a time. Violation of the resale prohibition may subject you to monetary damages and legal liability.
5. SHEIN Intellectual Property: You may not use SHEIN's intellectual property in any way without SHEIN's prior written consent. These Terms and Conditions and your purchase of customized products do not grant you any rights to such intellectual property (including any photos, illustrations, graphics, text, designs, or images available for you to customize).
6. Returns: Customized products cannot be returned or exchanged, unless we provided an incorrect customized product (for example, if the pattern on the customized product you received is not the one you submitted).
7. Modifications: We may modify these Terms and Conditions at our sole discretion and post the modified terms on the SHEIN.com website. Once the modified terms take effect, your continued purchase of customized products on SHEIN.com constitutes your acceptance of the modified terms.
